This Privacy Policy describes the types of information we may collect from you or that you may provide through utilizing the Out2Win Services. Out2Win’s Services include (a) the Website, (b) Out2Win’s SaaS-based website acceleration services and related technologies, and (c) all software made available by company in connection with its services as well as any content (which includes, but is not limited to data, reports, text, images, sounds, video, and content made available by Out2Win) (collectively referred to herein as the “Services”).

This Privacy Policy applies to information we collect on or through our Services and in any e-mail, text, and other electronic messages between you and the Services. Your use of our Services and any information you may provide through your use and/or access of the Services is subject to the terms of this Privacy Policy, as may be updated from time to time. Please read this Privacy Policy carefully before using the Services. This Privacy Policy does not apply to any third-party websites, services, or platforms, even if such are available or accessible through the Services, including the Website. This Privacy Policy is incorporated by reference into Out2Win’s Terms of Services (the “Terms”) which govern your use of the Services. Unless otherwise defined herein, all capitalized terms will have the same meaning as specified in the Terms.

By using the Services, you acknowledge that you have read, understood, and agree to be bound by the terms contained in this Privacy Policy. If you do not agree with our policies and practices, your choice is not to use our Services. Your continued use of the Services after we make changes is deemed to be acceptance of those changes, so please check this Privacy Policy periodically for updates.

INFORMATION WE COLLECT

The types of information we may collect and our privacy practices are dependent on your interaction with the Services and requirements of applicable law. Through your use of the Services or by use providing the Services, we may collect the following information:

  • Personal Information

    • User Provided Information – Out2Win may collect certain information by which you may be personally identified, including, without limitation, (i) full name; (ii) mailing address; (iii) phone number; (iv) email address; (v) photo provided by you; (vi) login credentials including username and password; (vii) company name and/or (viii) any other information by which you could be identified that you chose to provide (“Personal Information”). This information is collected directly from you when you provide it to us through the Services, including information provided at the time of registering for use of our Services, and/or through automatic features in the Services.

      Additionally, when you send a communication to Out2Win when using the Services (e.g., customer service inquiries, comments), Out2Win may also collect that communication and any information you choose to provide therein, and you agree Out2Win is free to use the content of any communications submitted by you for any purpose outlined herein.

      To make or receive a payment through the Services, you may need to register your financial account information with Out2Win’s payment processor. You may have to submit your name, your credit card number or other payment information, and billing information for verification purposes. This information allows our payment processor to process and fulfill your payment. Out2Win does not have access to your payment information or other information required for payment, and your sharing of such information is governed by our payment processor’s applicable privacy policy and terms of use.       In order to effectively utilize all the Services offered to you, you will need to register your financial account information to allow the payment processor to take or make payments earned via the Services to you. You acknowledge and agree that you are solely responsible for the accuracy of the information you have provided and for assuring that the information is the most up to date so payments can be made effectively.

    • Publicly Available Information – Out2Win may collect information about athletes from social media platforms and other public website and sources, some of which may contain Personal Information. Such information collected may include, but is not limited to, first and last name, social media handles, sport, school or team affiliation, gender, social media following and demographic information about your social media following, engagement, and price per post. This information is collected from publicly available information available via social media platforms and other publicly available sources and may be collected and shared without the knowledge or consent of the athletes. If you are an athlete and would like the information that Out2Win has collected from publicly available information removed from our Services, please contact us at contact@out2win.io.


    • Information We Collect from Other Sources – We and our business partners may collect and/or receive information about you, including Personal Information, from other sources, including, but not limited to, from third parties, service providers, affiliates, and publicly available sources (as outlined above). We may combine this information with other information we maintain about you. If we do so, this Privacy Policy governs any combined information that we maintain in personally identifiable format.


    • Non-Personal Information – Out2Win may collect certain non-personal information via your use of our Services. This may include information automatically collected when you access or interact with the Services. When you download, access, and use the Services, it may use technology to automatically collect usage data such as traffic data, location data, logs, and other communication data and resources that you access and use on or through the Services. We may also collect certain device information including, but not limited to: (i) the type of mobile device you are using; (ii) your mobile device unique identifier (IMEI); (iii) the IP address of your device; (iv) your device operating system; (v) the type of internet browser you are using; (vi) mobile network information; (vii) the device’s telephone number; and/or (viii) unique device information and other diagnostic data.


    • Aggregate Data – Out2Win may collect data that is about you but individually does not identify you, such as statistical information and analytic data relating to usage of the Services.

TECHNOLOGIES USED FOR AUTOMATIC DATA COLLECTION

  • Cookies and Other Tracking Technologies – Out2Win may use “cookies” to collect certain information to ensure that you get the most out of the Services. A cookie is a file stored on your computer or device to uniquely identify your browser or to store information or settings on your computer or device. When you visit our Services again, the cookie allows our website or platforms to recognize your browser. Cookies allow us to improve the Service’s usability and to personalize the content for you.     Our Platform and other Services may also use Web Beacons, which are small electronic files (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit Out2Win, for example, to count users who have visited those pages or opened an email and for other related Platform statistics (for example, recording the popularity of certain Platform content and verifying system and server integrity).


  • Third Party Cookies and Tracking Technologies – Third party service providers that we partner with may also place their own cookies on your device. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you. The information that they collect may be associated with your Personal Information or they may collect information, including Personal Information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. These third parties may include, but are not limited to, Google Analytics. We do not control these third parties’ tracking technologies or how they may be used. Note that this Privacy Policy covers only our use of cookies and does not include use of cookies by any third parties.


  • Google Analytics is a web analytics website offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our website and other Services. This data is shared with other Google websites. Google may use the collected data to contextualize and personalize the ads of its own advertising network.

    You can set preferences for how Google advertises to you using the Google Ad Preferences page. You can also opt-out of having made your activity on the Website available to Google Analytics by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js and dc.js) from sharing information with Google Analytics about visit activity. Such disclosures may include, and Out2Win reserves the right to, if you are a student athlete, disclose your data and information regarding your collegiate student-athlete NIL activities, including applicable Personal Information, to any relevant institution without notification to you or your consent, unless such notice or consent is required under applicable law;

  • To enforce or apply agreements or polices between you and Out2Win;

  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Out2Win, our employees, customers, student-athletes, or others.

Out2Win may also share anonymous, de-identified, and/or aggregate Personal Information for commercial, marketing, and/or legitimate business purposes, such as reporting and conducting research and development in order to enhance the Services. Anonymous, de-identified or aggregated information does not identify you, and we may use or disclose such information in a number of ways, including research, internal analysis, analytics, and any other legally permissible purposes. We may share this information internally and/or with third parties for our or their purposes. We may disclose aggregated information and information that does not identify any individual without restriction.

EXTERNAL PLATFORMS

Out2Win may use certain third-party websites, services or other resources, including social media platforms, on the Internet to help provide certain Services. In other instances, the Company may provide links to third-party websites, services or other resources including our partners and social media networks. Collectively, these third-party websites, services, and other resources are referred to herein as “External Platforms”.

Please be aware that Out2Win is not responsible for the privacy practices of any third party, including any third party with whom it has an affiliation or business relationship. Once you enter or use External Platforms, our Privacy Policy and Terms of Use do not apply. We do not control and accept no liability or responsibility for those External Platforms and this Privacy Policy does not apply to those External Platforms. Out2Win has several active communities online, including, but not limited to, X, LinkedIn, Instagram, and TikTok (collectively, “Social Media Platforms”). We encourage you to review our Social Media Platform pages and get involved. We appreciate dialog and discussion via Social Media Platforms, and look forward to your comments and experiences. However, such use of Social Media Platforms, including the use of direct or personal messages, are not governed by our Privacy Policy and are governed by the applicable Social Media Platform privacy policy and terms of use. Please remember that social media posts are often viewable publicly and are not private. We do not control and accept no liability or responsibility for such Social Media Platforms or your use of such platforms.

We may receive some information that you submit to External Platforms, including but not limited to information from your social media profile if you connect with us on Social Media Platforms.

We have implemented measures designed to secure your information from accidental loss and from unauthorized access, use, alteration, and disclosure. However, the safety and security of your information, including Personal Information, also depends on you.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your information, we cannot guarantee the security of your information, including your Personal Information, transmitted to our Services. Any transmission of your information, including Personal Information, is at your own risk.
